In a\u00a0previous post,<\/a>\u00a0we mentioned that the \u201cAsylum and Immigration\u201d Law, which was published in September 2018, would have consequences for business immigration<\/a>.\u00a0Most of the provisions came into effect on March 1. Below are the main changes that we recommend everyone be aware of.<\/p>\n As of March 1, 2019, declarations of residence and date of entry into the territory must be made via a\u00a0teleservice\u00a0<\/strong>within 3 months of arrival in France.<\/p>\n To qualify for the \u201cSalari\u00e9 detach\u00e9 ICT<\/em><\/a>\u201d or the \u201cstagiaire ICT<\/em>\u201d statuses, foreign assignees must from now on:<\/p>\n A\u00a06-months waiting period\u00a0<\/strong>now applies between 2 work placements or periods of work.<\/p>\n It is important to note that the non-renewable character of the \u201cSalari\u00e9 d\u00e9tach\u00e9 ICT\u201d and \u201cStagiaire ICT<\/em>\u201d is now expressly provided for by the law. In addition, the\u00a0maximum lengths\u00a0<\/strong>of the \u201cSalari\u00e9 d\u00e9tach\u00e9 ICT<\/em>\u201d and \u201cStagiaire ICT<\/em>\u201d status are now\u00a03 years\u00a0<\/strong>and\u00a01 year<\/strong>, respectively.<\/p>\n As part of the Change in Status process from \u201cstudent\u201d to \u201cemployee\u201d, the issuance of an employee or temporary worker resident permit is contingent upon a\u00a0minimum wage<\/strong>, the latter being adjusted depending on the diploma held by the applicants. In this respect, the\u00a0employment situation of the labor<\/a> market is no longer enforceable to the work permit applications<\/strong>.<\/p>\n Such card shall be valid for 12 months, similar to the APS in the past. The Law largely restates the former provisions relating to the Provisional Residence Authorization and specifies that the applicant must avail themselves and provide proof of private health insurance.<\/p>\n The Law\u00a0extends the right to obtain a card\u00a0<\/strong>to foreign nationals who have graduated from a French establishment of higher education and obtained a diploma equivalent to at least a Master\u2019s degree or a diploma listed by decree. Foreign nationals may now obtain such card\u00a0within four years\u00a0<\/strong>following their graduation.<\/p>\n For their part,bilateral agreements providing for specific time-limits<\/strong>are not challenged.<\/p>\n Such status is granted to foreign nationals whose national or international renown is well-established and who come to France to engage in employed or self-employed activities in either scientific, literary, artistic, intellectual, educational or athletic fields. The Status is now extended to people whose national or international renown likely contributes\u00a0to France\u2019s economic and urban development or influence<\/strong>.
